1. Acceptance of Terms
By creating an account, accessing, or using Crush.lu ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
Crush.lu uses a two-tier consent system. You must separately consent to:
- The creation of your PowerUp Account (identity layer)
- The creation of your Crush.lu Profile (dating profile layer)
Each consent is recorded with your IP address, timestamp, and the version of these Terms you accepted. This version is 2.0.
2. Definitions
- Platform: The Crush.lu website, Progressive Web App (PWA), and all associated services.
- PowerUp Account: Your base identity account (email, name, authentication), which may be shared with other platforms we operate.
- Crush.lu Profile: Your dating profile including photos, bio, interests, and all Crush.lu-specific data.
- Coach: An authorised representative of Crush.lu who reviews profiles, facilitates connections, and moderates interactions.
- Event: Any in-person meetup, speed dating session, mixer, or activity organised through the Platform.
- Connection: A coach-facilitated link between two users who met at an Event, requiring bilateral consent.
- Crush Spark: An anonymous admirer feature where a user creates a personalised journey for someone they liked at an Event.
- Journey: An interactive multi-chapter experience (Wonderland, Advent Calendar, or custom) with challenges and rewards.
- Content: Any text, photos, videos, audio, or other material you submit to the Platform.
3. Eligibility
To use Crush.lu, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Platform under Luxembourg or EU law
- Not have been previously banned from the Platform
- Maintain only one account
By creating an account, you represent and warrant that you meet all eligibility requirements. Users who have been banned may not re-register under a different identity.
4. Account Registration
4.1 Account Types
Crush.lu uses a two-tier account system:
- PowerUp Account: Your identity layer with email, name, and login credentials. Required for all platform access.
- Crush.lu Profile: Your dating profile with photos, bio, interests, and privacy settings. Required for events and connections.
4.2 Account Creation
- You must provide accurate, current, and complete information during registration
- You may register via email/password or social login (Google, Facebook, Microsoft, LinkedIn)
- Each person may only create one account
- You are responsible for maintaining the confidentiality of your login credentials
- You must notify us immediately of any unauthorised access to your account
4.3 Phone Verification
To complete your Crush.lu Profile, you must verify your phone number via SMS one-time password (OTP). This verification is processed through Firebase and is required to prevent duplicate accounts and enhance trust.
4.4 Profile Approval
All Crush.lu Profiles are reviewed by our Coaches before approval. This process typically takes up to 48 hours. We reserve the right to:
- Request revisions to your profile content or photos
- Reject profiles that violate our community standards
- Require a screening call before profile activation
- Require you to recontact your assigned Coach for additional information
5. User Conduct
You agree not to:
- Misrepresent your identity, use false information, impersonate others, or create fake profiles
- Engage in harassment, bullying, stalking, or abusive behaviour toward other users
- Discriminate based on race, ethnicity, religion, gender, sexual orientation, or disability
- Send unsolicited promotional content or spam
- Request money, financial information, or commercial favours from other users
- Share private information of other users without their consent
- Use the Platform for any illegal purpose
- Use automated tools, bots, or scripts to scrape or collect user data
- Circumvent privacy features, including attempting to identify anonymous Crush Spark senders
- Maintain multiple accounts or create a new account after being banned
- Use the Platform for commercial purposes without our written permission
- Pressure other users for personal contact information outside of the Platform's connection system
- Record, photograph, or livestream events without explicit permission from all attendees
- Provide false accessibility or dietary information when registering for events
- Attempt to reverse-engineer, decompile, or interfere with Platform security
6. Content Guidelines
6.1 Profile Content
Your profile photos and bio must:
- Be appropriate and non-explicit
- Accurately represent you (recent photos, taken within the last year)
- Feature you as the primary subject (no group photos as your main photo)
- Not include embedded contact information (email, phone, social media handles, URLs)
- Not promote products, services, or other platforms
- Not contain nudity, sexually explicit material, violence, illegal drugs, or weapons
- Not depict or include minors (anyone under 18)
- Not infringe on intellectual property rights
6.2 Journey & Crush Spark Media
Media uploaded for Journeys and Crush Sparks (photos, videos, audio) must follow the same content standards as profile content. All Crush Spark content is reviewed by a Coach before delivery.
6.3 Messaging
Messages exchanged through connections are subject to coach moderation. Coaches may review messages to ensure community standards are maintained. Messages must not contain threats, harassment, or explicit content.
6.4 Content Licence
You retain ownership of all Content you post on the Platform. By posting Content, you grant Crush.lu a worldwide, non-exclusive, royalty-free licence to use, display, and distribute your Content solely for the purpose of operating and providing the Platform's services.
This licence terminates when you delete your Content or your account, except where your Content has been shared with other users through legitimate Platform features (e.g., delivered Crush Sparks or messages in active connections).
7. Events
7.1 Registration
- Only users with approved Crush.lu Profiles can register for events
- Events may have capacity limits, gender-specific caps, age requirements, and language requirements
- Registration is subject to availability — you may be placed on a waitlist
- Some events are private or invitation-only and require an invitation code
7.2 Event Conduct
- Treat all attendees and staff with respect and courtesy
- Follow event rules and Coach instructions at all times
- Do not pressure others for contact information — use the Platform's connection system
- Report any inappropriate behaviour to Coaches immediately
- Do not record, photograph, or livestream without permission from all attendees
7.3 Cancellation & Refund Policy
For paid events, the following refund policy applies:
- More than 48 hours before the event: Full refund
- Between 24 and 48 hours before the event: 50% refund
- Less than 24 hours before the event: No refund
If Crush.lu cancels an event, all registered attendees will receive a full refund regardless of timing.
7.4 No-Show Policy
You must attend events you register for or cancel in advance. Users who accumulate 3 or more no-shows may face restrictions on future event registrations.
7.5 Guests
Some events allow guests. If you bring a guest, you are responsible for ensuring they comply with these Terms and event rules. Guest information (name) is collected at registration.
7.6 Private & Invitation-Only Events
Private events require an invitation code. Invitation codes are personal and may not be shared unless explicitly permitted. Invitations may be subject to Coach approval.
8. Coach-Facilitated Connections
8.1 Process
After attending an event, you may request a connection with another attendee. The process is:
- You submit a connection request with an optional personal note
- A Coach reviews the request
- Both parties must provide bilateral consent before any contact information is shared
- Once both consent, the Coach may provide a personalised introduction
8.2 Coach Role
Coaches are authorised representatives of Crush.lu. They facilitate connections, mediate interactions, and ensure community safety. Coach decisions regarding connection approvals are final.
8.3 Messaging
Messages between connected users are subject to moderation. Coaches may review messages to maintain community standards. Keep messages respectful and appropriate.
8.4 Contact Sharing
Personal contact information is shared only after both users have provided explicit consent and the Coach has approved the connection. Respecting boundaries is mandatory — 'no' means no.
9. Crush Spark (Anonymous Admirer)
Crush Spark allows you to create an anonymous personalised journey for someone you liked at an event. By using this feature, you agree to the following:
- You may send a Crush Spark only to someone who attended the same event as you
- Your anonymous description of the recipient is reviewed by a Coach, who identifies and assigns the recipient
- You create a personalised journey with optional media (photos, video, audio)
- Your identity remains anonymous until the recipient completes Chapter 6 of the journey
- Once a Spark is delivered to the recipient, it cannot be withdrawn
- Crush Sparks expire after 14 days if the journey is not completed
- All Spark content must comply with our Content Guidelines (Section 6)
- The number of Sparks per event may be limited
10. Interactive Journeys
- Challenge submissions (text, photos, video, audio) may be reviewed by Coaches
- Points earned and digital rewards within journeys have no monetary value and cannot be exchanged for cash or goods
- Advent Calendars follow a date-locked schedule; doors open according to the calendar's configured dates
- Journey progress and responses are stored as part of your account data and can be exported or deleted
- Completion certificates are generated automatically and are not official documents
11. Wallet Passes
You may optionally add your Crush.lu membership or event tickets to Apple Wallet or Google Wallet:
- Wallet passes are subject to Apple's and Google's respective terms of service
- You control whether your profile photo appears on your wallet pass
- Passes are updated automatically when your profile or event status changes
- You can remove your pass from your wallet at any time through your device settings
- Wallet passes store device identifiers and push tokens necessary for pass delivery and updates
12. Referral Programme
- Approved users receive a unique referral code that can be shared with friends
- Successful referrals (when a referred user creates an approved profile) earn referral points
- Points contribute to membership tiers: Basic, Bronze, Silver, Gold
- Referral points and tiers have no monetary value
- Fraudulent referrals (self-referral, fake accounts, incentivised signups) will result in point forfeiture and possible account suspension
- We reserve the right to modify, suspend, or terminate the referral programme at any time with notice to participants
13. Payment & Fees
- Creating an account and profile on Crush.lu is free
- Some events may require a registration fee, which is clearly displayed before registration
- Payment is processed securely through our payment provider
- All prices are displayed in Euros (EUR) and include applicable taxes
- Refunds are subject to our cancellation policy (see Section 7.3)
- We reserve the right to change event pricing with reasonable notice; price changes do not affect existing confirmed registrations
14. Intellectual Property
14.1 Your Content
You retain ownership of all Content you post. The licence you grant us is described in Section 6.4 and is limited to operating the Platform.
14.2 Our Content
The names Crush.lu, Crush Coach, and Crush Spark, as well as the Platform's logo, design, and functionality, are proprietary to Crush.lu and protected by intellectual property laws. You may not copy, reproduce, or distribute our content without written permission.
15. Privacy & Data Protection
Your use of Crush.lu is also governed by our Privacy Policy, which describes in detail how we collect, use, and protect your personal data.
Key data protection features include:
- Two-tier deletion: delete your Crush.lu Profile only or your entire account
- Data export: download your personal data in JSON format from your account settings
- Privacy controls: choose what other users can see (name, age, photo blur)
- GDPR rights: access, rectification, erasure, restriction, portability, objection
16. Disclaimers & Liability
16.1 No Guarantees
Crush.lu is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee:
- That you will meet compatible partners or form relationships
- The accuracy of information provided by other users
- Uninterrupted or error-free service
- That the Platform is free from viruses or harmful components
16.2 Safety Disclaimer
While we review profiles and facilitate connections through coaches, we cannot guarantee the conduct of users. You are responsible for your own safety:
- Always meet in public places for first meetings outside of organised events
- Trust your instincts and prioritise your safety
- Report suspicious behaviour to Coaches or support@crush.lu immediately
- We are not responsible for interactions between users that occur outside of organised events
16.3 Limitation of Liability
To the fullest extent permitted by law, Crush.lu's total liability to you for all claims arising from or relating to your use of the Platform shall not exceed the greater of: (a) the total fees you have paid to Crush.lu in the 12 months preceding the claim, or (b) EUR 100.
In no event shall Crush.lu be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
16.4 Indemnification
You agree to indemnify and hold harmless Crush.lu, its officers, employees, coaches, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms, (b) your Content, (c) your interactions with other users, or (d) your violation of any applicable law.
16.5 EU Consumer Protection
Nothing in these Terms affects your statutory rights as a consumer under EU or Luxembourg consumer protection law. Where mandatory consumer protection provisions apply, they take precedence over any conflicting provision in these Terms.
17. Suspension & Termination
17.1 Termination by You
You may terminate your account at any time through your account settings. You have two options:
- Delete Crush.lu Profile: Removes your dating profile, photos, connections, and event history. Your PowerUp Account remains active for other platforms.
- Delete Full Account: Removes your PowerUp Account and all associated data across all platforms. Your account is anonymised.
17.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Pose a safety risk to other users
- Repeatedly receive complaints from other users or coaches
- Circumvent a previous ban
We will notify you of the suspension or termination and the reason. Banned users are permanently prohibited from creating new accounts.
You may appeal a suspension or ban within 30 days by contacting legal@crush.lu. Appeals will be reviewed and you will receive a response within 14 business days.
17.3 Effects of Termination
Upon termination:
- Your profile is no longer visible to other users
- Active connections and messages are deactivated
- Event registrations are cancelled
- Data deletion follows the retention periods described in our Privacy Policy
- Referral points and membership tier are forfeited
18. Dispute Resolution
18.1 Governing Law
These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to its conflict of laws provisions.
18.2 Informal Resolution
Before filing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at support@crush.lu. We will make reasonable efforts to resolve the issue within 30 days.
18.3 EU Online Dispute Resolution
In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers. You can access it at: https://ec.europa.eu/consumers/odr
18.4 Jurisdiction
Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Luxembourg City, except where mandatory consumer protection provisions require a different jurisdiction.
19. Force Majeure
Crush.lu shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, government orders, cyberattacks, infrastructure failures, or acts of war.
If an event is cancelled due to force majeure, all registered attendees will receive a full refund of any fees paid, regardless of the cancellation policy.
20. General Provisions
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crush.lu regarding your use of the Platform.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of assets.
- Electronic Notices: You consent to receiving notices from us electronically, via email or through the Platform. Electronic notices satisfy any legal requirement for written communication.
21. Changes to Terms
We may update these Terms from time to time. For material changes, we will:
- Provide at least 30 days' notice before the changes take effect
- Require you to re-confirm your consent via our consent system before continuing to use the Platform
- Update the version number and 'Last Updated' date at the top of this page
Your continued use of Crush.lu after re-consenting constitutes acceptance of the updated Terms.
